On cemeteries and burial
The Representative Body of Tiborszállás Village Municipality, acting on the basis of the authority granted in Section 41 (3) of Article 41 of Act XLIII of 1999 on Cemeteries and Cemeteries, and in accordance with the powers defined in Section 13 (1) (2) of Act CLXXXIX of 2011 on Local Governments of Hungary, acting in its capacity as defined in Section 13 (1) (2) of Act XLIII of 1999 on Cemeteries, and after consulting the National Association of Consumer Protection Associations, acting in its opinion-giving capacity as provided in Section 40 (5) of Act XLIII of 1999 on Cemeteries, hereby decrees the following:
- General provisions
- §
The scope of the Decree covers the public cemetery (hereinafter referred to as "the cemetery") in the administrative territory of the Municipality of Tiborszállás, owned by the Municipality of Tiborszállás (hereinafter referred to as "the maintainer"), located at the cadastral parcels 044/20 and 048/4 of Tiborszállás.
- §
(1) The maintenance of the cemetery shall be the responsibility of the maintainer.
(2) The operation of the cemetery and the services specified in accordance with Section 8 pursuant to Section 40 (1) of Act XLIII of 1999 on Cemeteries (hereinafter referred to as "Act XLIII of 1999 on Cemeteries") shall be provided by Szabolcs-Szatmár-Bereg County Cemetery Ltd (4400, Nyíregyháza, Pazonyi tér 5) (hereinafter referred to as "the operator") on the basis of the public funeral service contract concluded with the operator pursuant to Section 8 of the Decree and the public funeral service contract concluded with the operator.zunder the terms of the agreement.
- Rules for the use and enjoyment of the cemetery and funeral parlour
- §
(1) Opening hours of the cemetery:
- a) 1 April - 30 October 6.30-20.00,
- b) 2 November - 31 March 7.00-17.30,
- c) 31 October and 1 November from 6.30-21.00.
(2) During the opening hours, the cemetery is open to the public without any restrictions.Children under the age of 12 may enter the cemetery only under the supervision of an adult.
- §
Any candle lit in a cemetery, except for a sealed candle, must be extinguished by the person who lit it before leaving.
- §
At the water points provided in the cemetery, water may be taken only as and to the extent necessary for the use of the cemetery.
- §
(1) The holder of the right of disposal of the burial plot shall.
- a) to regularly take care of the grave site and weed it,
- b) take care of the planted vegetation,
- c) maintain the area up to half the distance between the graves,
- d) to ensure the preservation of the grave site and the grave marker, and to remove any condition that compromises safe use.
(2) The rules set out in paragraph (1) shall apply to the maintenance of the gravesites, except that in the absence of the person designated therein, the operator shall be responsible for the maintenance of the gravesites at the expense of the operator.
(3) In the care of the burial place, it shall be ensured that the activities related to:
- a) not result in contamination and damage to adjacent burial sites,
- b) do not harm the feelings of piety of others,
- c) do not interfere with the graveside activities of others or with road traffic,
- d) do not disturb the ceremony during the farewell service.
6/A. §
(1) Only objects for the decoration of graves, tombs, tombs, in particular wreaths, vases, candles, candles, may be placed in the cemetery.
(2) The funerary objects may not extend beyond the area of the burial place redeemed by the holder of the right of disposal of the burial place.
(3) In the event of a breach of the obligation under paragraph (2), the operator shall, by setting a deadline, request in writing the holder of the right of disposal of the burial place to restore the burial place to its lawful condition, and in the event of failure to do so, to remove the encroaching object of veneration at the expense of the holder of the right of disposal of the burial place.

- The grave monument, grave shelter, grave marker, kerbstone and vegetation planted over the burial place shall not extend beyond the area of the burial place purchased by the holder of the right of disposal over the burial place.
(2) In the event of a breach of the obligation under paragraph (1), the operator shall, by setting a deadline, request in writing the holder of the right of disposal over the burial ground to restore the burial ground to its lawful state, and in the event of failure to do so, to restore and remove the overhanging vegetation at the expense of the holder of the right of disposal over the burial ground.
(3) In the burial ground, in its immediate vicinity and in the public cemetery, plants may be planted only with the prior written consent of the operator, if they are taller than 0.8 m.
(4) In the event of a breach of the obligation under paragraph (3), the operator shall, by setting a time limit, request in writing the holder of the right of disposal of the burial ground to restore the burial ground to its lawful state. If the notice is not successful, the operator shall have the improperly planted plant removed at the expense of the holder of the right of burial.
- §
(1) In the cemetery, refuse, wreaths and flowers shall be deposited in the designated dumping place.
(2) Only assistance or service dogs may be brought into the cemetery.
(3) It is only allowed to drive into the cemetery and to park a car in the parking lot of the cemetery designated for this purpose. Beyond this limit, only vehicles transporting the dead, seriously disabled persons, persons with reduced mobility, persons using special signs, persons intending to enter the cemetery for work purposes and persons performing funeral services may enter the cemetery.
- Services provided by the operator
- §
The use of the operator's professional staff and equipment within the cemetery is compulsory for the following services:
- a) cooling the deceased,
- b) the funeral of the deceased,
- c) transport of the deceased in a transport vehicle provided for this purpose in the cemetery,
- d) the tomb installation,
- e) grave digging, grave opening
- f) the recall,
- g) the reburial,
- h) the exhumation,
- i) urine placement.
- Management rules for the burial ground
- §
(1) A maximum of 2 urns may be placed in urn number one and a maximum of 4 urns in urn number two.
(2) No more than 4 urns may be placed below ground level in an urn vault and no more than 2 urns may be placed above ground level on the urn vault.
- §
The deceased does not have to be buried in the next burial place in order of time of death in the following cases:
- a) burial in a double grave,
- b) the burial,
- c) the burial in a burial plot.
- §
(1) Duration of the right of disposal of the burial place:
- a) 25 years from the date of burial and reburial in the case of burial in coffins and reburial,
- b) 60 years for a tomb.
- c) 25 years in the case of an urn burial place and an urn tomb.
(2) The right to dispose of the burial place may be renewed for the period referred to in paragraph (1).
- Dimensions of the graves
- §
(1) In the case of a coffin burial, each grave
- a) width: 95 cm, 65 cm for children dead,
- b) length: 220 cm, 150 cm for children dead.
(2) In the case of a cremation burial, the number of
- a) width: 65 cm,
- b) length: 80 cm.
- §
(1) The 2-person tomb
- a) width 180 cm,
- b) length 220 cm.
(2) The 4-person tomb
- a) width 240 cm,
- b) length 220 cm.
(3) The 6-person tomb
- a) width 320 cm,
- b) length 220 cm.
- §
(1) For urns placed only above ground level and for up to 2 urns below ground level, the urn burial
- a) width 65 cm,
- b) length 80 cm.
(2) A if more than 2 urns are placed below ground level, the urn store
- a) width 90 cm,
- b) length 80 cm.
- §
(1) In the case of a funeral:
- a) the distance between the sides of the graves is 60 cm,
- b) the distance between the rows must be at least 60 cm and not more than 100 cm.
(2) By way of derogation from paragraph (1), the distance between the rows of head-headed grave markers shall be 30 cm between the headboards and 1,5 m between the rows.
- Gravestones
- §
Only the construction of grave markers and the renovation of existing grave markers is permitted in the cemetery, which does not impede the proper further construction, care and maintenance of the cemetery or the grave marker, or the use of the cemetery infrastructure.
- Different provisions for ornamental graves
- §
Ornamental graves are those reserved for this purpose in a specially designated area of the cemetery.
- §
In the place of honour, the widow and partner of the deceased may be placed in the grave, subject to the rules for opening and reburial.
- Rules for the provision of funeral services and other contractor activities in cemeteries
- §
The excavation of the grave can only be started after the client has confirmed the payment of the deposit. The grave must be excavated to the correct dimensions so that it can be safely placed in the grave pit without endangering the safety of life and property or the interests of others.
- §
The funeral parlour must be opened by the operator at least 1 hour before the funeral and made available to the buried and mourners.
- §
(1) Any work in the cemetery, except for grave maintenance by relatives, planting and decoration of the burial place, shall be notified to the cemetery operator before the work is started.
(2) The erection of gravestones and other works in the cemetery may take place during the opening hours from Monday to Friday. The erection and renovation of gravestones may only take place outside the period of funeral services.
(3) Only finished gravestones and building materials necessary for the construction of a grave shelter and grave shelter frame may be brought into the cemetery. The place and method of storage of the material shall be designated by the operator.
(4) The contractor shall remove any waste or debris generated during the erection or repair of the tomb upon completion of the work.
- Awards
- §
(1) A fee is payable for the change or redemption of the burial place.
(2) With the exception of funeral service providers, persons carrying out business activities in a cemetery shall pay a cemetery maintenance fee.
(3) Cemetery service providers shall be charged a fee for the use of the cemetery facilities and for the services provided by the operator.

The rates of the fees provided for in Article 22 are set out in Annex 1 to the Regulation.
- §
There is no charge for driving into the cemetery.
- Final provisions
- §
This Regulation shall enter into force on 1 June 2023.
- §
The Municipal Decree 15/2000 (XII. 1.) on the cemetery and the burial is repealed.

Fees applicable at the cemetery
- Fees for the redemption and redemption of burial places:
- a) single grave: 5.000 HUF
- b) second grave: 10.000 HUF
- c) single urn: 5.000 HUF
- d) second urn: 10.000 forint
- e) urn tomb: 8.000 forint
- Cemetery maintenance fee: 600 forints/application.
- Facility charges:
- a) funeral parlour fee: 10.000 HUF/death
- b) dead fridge fee: 600 HUF/day
- Provided by the operator
- a) fee for cooling the deceased: 700 HUF/day/deceased
- b) funeral fee for the deceased: urn funeral: 16.000 HUF/urn, coffin funeral 24.000 HUF/deceased
- c) the fee for the transport of the deceased in a transport vehicle provided for this purpose in the cemetery: 13.300 HUF/deceased
- d) the fee for the grave placement: 16.000 HUF/plot
- e) grave digging, grave opening fee: 24.000 HUF/plot
- f) fee for the return: 23.000 HUF/plot
- g) reburial fee: 32.750 HUF/burial
- h) exhumation fee: 67.100 HUF/deceased
- i) the fee for the urn placement: 36.000 HUF/ urn
